IV.2. Miscellaneous
\n<\/strong>IV.2.1. Economy, Finance and Taxation<\/strong><\/p>\n

The Council of Ministers approved the decree-law that establishes the rules for implementing the State Budget for 2018, which aims to guarantee an adequate budget execution, indispensable to compliance with the provisions of the State Budget Law for 2018.<\/p>\n

In this context, was also approved the decree-law which made the rules on the activity of investment funds simpler and clearer, as they were consolidated in a single instrument \u2013 in this case, the General Regime of Collective Investment Entities, thus completing the Government an important step towards making the Portuguese market more dynamic and efficient and thus more competitive in attraction of investments.<\/p>\n

Among the main changes highlight: the faster and more predictable authorisation procedure for investment funds, the more flexible windows for subscription and redemption of real estate investment funds for the managing entities and more attractive for the small investors.<\/p>\n

The present law also introduces a set of amendments to the Legal Regime of Venture Capital, of the Social Entrepreneurship and Specialized Investment, and to the Legal Regime of the Investment Companies for the\u00a0 Fomentation of Economy.

Was approved the\u00a0draft of Law which amends the legal regime applicable to the processing of data relating to the judicial system<\/strong>, and which introduces a set of guarantees aimed at ensuring a high level of protection of personal data within the judicial system, where is necessary a particular concern about the circulation of information in the context of the processing of the processes in several instances and by different entities.<\/p>\n

Was also approved the\u00a0draft of Law transposing the EU Directive no. 2016\/680 on the processing of personal data by the competent authorities for the prevention, investigation, detection or prosecution of criminal offenses or of execution of criminal sanctions, including the threats to public security<\/strong>. The data processed should be restricted to those which are specifically necessary for the proposed purpose, pursuing the so-called principle of “protection of data from conception and by default<\/em>“.
