{"id":11863,"date":"2025-06-12T17:17:30","date_gmt":"2025-06-12T17:17:30","guid":{"rendered":"https:\/\/e-legal-blawg.com\/?p=11863"},"modified":"2025-07-03T13:07:36","modified_gmt":"2025-07-03T13:07:36","slug":"legal-updates-in-portugal-may-2025","status":"publish","type":"post","link":"https:\/\/e-legal-blawg.com\/en\/2025\/06\/12\/legal-updates-in-portugal-may-2025\/","title":{"rendered":"Legal updates in Portugal &#8211; May 2025"},"content":{"rendered":"<div id=\"cs-content\" class=\"cs-content\"><div id=\"ed\" class=\"x-section offset-anchor\" style=\"margin: 0px;padding: 45px 0px 0; background-color: transparent;\" ><div id=\"\" class=\"x-container max width\" style=\"margin: 0px auto;padding: 0px;\" ><div  class=\"x-column x-sm x-1-1\" style=\"padding: 0px;\" ><div id=\"ed\" class=\"x-text\" style=\"\" ><p><b><span data-contrast=\"auto\">I. <\/span><\/b><strong>EDITORIAL \u2013 <\/strong><strong>AMENDMENT OF THE GENERAL WASTE MANAGEMENT REGIME; DEFINITION OF THE UNIVERSE OF PERSONS LIABLE FOR VALUE ADDED TAX<\/strong><\/p>\n<p>The month of May was characterized, <strong>in legislative terms<\/strong>, by the publication of <a href=\"https:\/\/files.diariodarepublica.pt\/1s\/2025\/05\/09800\/0001000016.pdf\"><strong>Decree-Law no. 81\/2025, of May 22<\/strong><\/a>, which amends the General Waste Management Regime, completing the transposition of Directive (EU) 2018\/851, and by the publication of <a href=\"https:\/\/files.diariodarepublica.pt\/1s\/2025\/05\/10300\/0000200003.pdf\"><strong>Ordinance no. 242\/2025\/1, of May 29<\/strong><\/a>, which defines the universe of value added tax payers covered by the automatic periodic declaration.<\/p>\n<p>Also noteworthy, at a <strong>legislative level<\/strong>, are:<\/p>\n<ul>\n<li><a href=\"https:\/\/files.diariodarepublica.pt\/1s\/2025\/05\/08600\/0000200004.pdf\"><strong>Decree-Law no. 71\/2025, of May 6<\/strong><\/a>, which amends Decree-Law no. 176\/2003, of August 2, which defines and regulates protection in the event of family burdens under the family protection subsystem;<\/li>\n<li><a href=\"https:\/\/files.diariodarepublica.pt\/1s\/2025\/05\/09700\/0001200057.pdf\"><strong>Ordinance no. 228\/2025\/1, of May 21<\/strong><\/a>, which approves and regulates the revised Domestic Violence Risk Assessment Tool (RVD-R).<\/li>\n<\/ul>\n<p>Within the scope of <strong>case law<\/strong>, we highlight the <a href=\"https:\/\/www.dgsi.pt\/jstj.nsf\/954f0ce6ad9dd8b980256b5f003fa814\/c4059b9e4e3cfed680258c8c00348216?OpenDocument\"><strong>Supreme Court of Justice's ruling of May 15, Case no. 741\/22.1T8MAI.P1.S1<\/strong><\/a>, in which it was ruled: \u201c<em>I. The rules of Portuguese law that cannot be derogated from, particularly for the purposes of applying Article 8(1) of the Rome I Regulation, are those relating to the very existence of a holiday allowance and a Christmas allowance. II. The legal regulation of holiday and Christmas allowances is intended to guarantee workers the availability of money that will allow them to meet the increased expenses that these seasons entail or may entail and, specifically with regard to holidays, to motivate them to enjoy them effectively, and is not based on strictly retributive considerations. III. Even if the individual employment contract is governed by the law of another country (under the terms chosen by the parties), payment of holiday and Christmas bonuses is compulsory for workers whose employment contract is being carried out in Portugal. IV. Referral may be refused by the national courts of a Member State, particularly where the answer to the question raised would have no bearing on the outcome of the dispute or where there is no reasonable doubt as to the interpretation of the provision of EU law at issue<\/em>\u201d.<\/p>\n<p>Finally, in the <a href=\"https:\/\/www.portugal.gov.pt\/pt\/gc24\/governo\/comunicado-do-conselho-de-ministros?i=671\"><strong>Miscellaneous<\/strong><\/a>, the Council of Ministers approved the Decree-Law that sets transitional targets for the integration of energy from renewable sources for the industry (16 per cent by 2030) and transport (29 per cent by 2030) sectors, which will be in force until European Union directives on the promotion of energy from renewable sources are transposed.<\/p>\n<\/div><\/div><\/div><\/div><div id=\"ju\" class=\"x-section offset-anchor\" style=\"margin: 0px;padding: 0 0px 45px; background-color: transparent;\" ><div id=\"\" class=\"x-container ju3 max width\" style=\"margin: 0px auto;padding: 0px;\" ><div  class=\"x-column x-sm x-1-1\" style=\"padding: 0px;\" ><div id=\"le\" class=\"x-text offset-anchor\" style=\"\" ><p><strong>II. Industrial Property <\/strong><\/p>\n<p>On 13 May, provisional statistics were released on industrial property rights (IPR) applications and grants for April 2025, highlighting the following:<\/p>\n<p>(i) In the first four months of 2025, 316 national invention applications were filed (up from 305 applications filed in the same period last year);<\/p>\n<p>(ii) With regard to grants, 100 national inventions were granted between January and April 2025, compared to 67 granted between January and April 2024, representing an increase of 49.3%;<\/p>\n<p>(iii) The total number of International Applications (PCT) and European Patents, via INPI as the Receiving Office, was 27 applications in the first four months of 2025 and 22 applications in the first four months of 2024.
