In addition, the month of February was marked by the publication of <a href=\"https:\/\/files.diariodarepublica.pt\/1s\/2025\/02\/03800\/0000400005.pdf\"><strong>Law no. 16\/2025, of February 24<\/strong><\/a><strong><u>,<\/u><\/strong> which authorises the government to partially transpose Directives (EU) 2020\/285 and (EU) 2022\/542, on the value added tax exemption regime applicable to small businesses.<\/p>\n<p>Also noteworthy, at a <strong>legislative level<\/strong>, are:<\/p>\n<ul>\n<li><a href=\"https:\/\/files.diariodarepublica.pt\/1s\/2025\/02\/03300\/0000300004.pdf\"><strong>Law no. 11\/2025 of February 17<\/strong><\/a><strong>, <\/strong>which authorises the government to partially transpose Directive (EU) 2022\/542 with regard to value added tax rates, amending the VAT Code and the special taxation regime for second-hand goods, works of art, collectors' items and antiques;<\/li>\n<li><a href=\"https:\/\/files.diariodarepublica.pt\/1s\/2025\/02\/03300\/0002500027.pdf\"><strong>Ordinance 41\/2025\/1 of February 17<\/strong><\/a><strong>, <\/strong>which amends the financial statement models for the different entities that apply the Accounting Standardisation System, following the changes to Accounting and Financial Reporting Standard 25;<\/li>\n<li><a href=\"https:\/\/files.diariodarepublica.pt\/1s\/2025\/02\/04000\/0000400004.pdf\"><strong>Law no. 18\/2025, of February 26<\/strong><\/a>, which authorises the government to amend the cash VAT regime, approved by Decree-Law no. 71\/2013, of May 30.<\/li>\n<\/ul>\n<p>Whitin the scope of<strong> case law<\/strong>, we highlight the <a href=\"https:\/\/www.tribunalconstitucional.pt\/tc\/acordaos\/20250142.html\"><strong>Judgement of the Constitutional Court no. 142\/2025, of February 18, Case no. 459\/2023<\/strong><\/a><strong>,<\/strong> in which it decided: \"<em>i) To not declare unconstitutional the rule arising from paragraphs 4 and 5 of article 84 of the Competition Legal Framework, approved by Law no. 19\/2012, of May 8, in its original wording, which determines that the appeals to decisions of the Competition Authority imposing fines have, as a rule, merely devolutive effect, and may only be given suspensive effect when the execution of the decision causes the defendant considerable damage and the latter provides security in lieu thereof; and consequently; ii) To dismiss the appeal<\/em>.\"<\/p>\n<p>Finally, in <a href=\"https:\/\/www.portugal.gov.pt\/pt\/gc24\/governo\/comunicado-do-conselho-de-ministros?i=660\"><strong>Miscellaneous<\/strong><\/a>, the Council of Ministers approved two law proposals to be submitted to Parliament: (i) one amending the provisions of the Code of Civil Procedure relating to the distribution of cases; (ii) the other adding amendments, following the approval of the law on the Centre for Judicial Studies (CEJ), to the statutes of Judicial Magistrates, the Public Prosecutor's Office and the Administrative and Tax Courts, as well as to the Law on the Organisation of the Judicial System.<\/p>\n<\/div><\/div><\/div><\/div><div id=\"ju\" class=\"x-section offset-anchor\" style=\"margin: 0px;padding: 0 0px 45px; background-color: transparent;\" ><div id=\"\" class=\"x-container ju3 max width\" style=\"margin: 0px auto;padding: 0px;\" ><div  class=\"x-column x-sm x-1-1\" style=\"padding: 0px;\" ><div id=\"le\" class=\"x-text offset-anchor\" style=\"\" ><p><strong>II. Industrial Property <\/strong><\/p>\n<p>On February 12, provisional statistical data on Industrial Property Rights (IPR) applications and grants for January 2025 \u00a0was released:<\/p>\n<p>i) In January 2025, were filed, 64 national invention applications up from 57 in the same period last year;<\/p>\n<p>ii) As far as grants are concerned, 31 national inventions were granted in January 2025, compared to 18 in 2024, which represents an increase of 7.2 per cent;<\/p>\n<p>iii) The total number of International (PCT) and European Patent applications was 6 in 2025;<\/p>\n<p>iv) The number of objects included in National Design applications rose from 39 in January 2024 to 103 in 2025;<\/p>\n<p>v) National Trademarks Other Distinctive Signs (OSDC) registered 2,109 applications in January 2025 (up from 2,027 applications in the same period in 2024), representing growth of 4 per cent.<\/p>\n<p>vi) In January 2025, there were 17 applications for International Trademarks originating in Portugal, more than the 6 applications registered in the same period in 2024.
