I. EDITORIAL – AMENDMENT TO DECREE-LAW NO. 127/2013, OF AUGUST 30, ESTABLISHING THE LEGAL FRAMEWORK FOR INDUSTRIAL EMISSIONS
Despite the lower legislative activity in August, the month was characterized, in legislative terms, by the publication of Decree-Law No. 89/2025, of August 12, which amended Decree-Law No. 127/2013, of August 30, which establishes the legal regime for industrial emissions, completing the transposition of Directive (EU) No. 2010/75/EU on industrial emissions. The publication of this Decree-Law aims to correctly transpose the Directive into national law and to close the infringement proceedings brought by the European Commission against the Portuguese State, which gave rise to Case No. C-166/25 registered with the Court of Justice, on the grounds of incorrect transposition of several articles of the Industrial Emissions Directive.
Also noteworthy, at a legislative level, are:
- Ordinance No. 286/2025/1, of August 14, which created the incentive system «Financial Instrument for Innovation and Competitiveness» (IFIC), under Component C05 ― Capitalization and Business Innovation of the Recovery and Resilience Plan (“PRR”), approving the respective regulation, which aims to support business investment projects in innovative and qualified activities or in research and development processes, promoting the link between companies and science, with special emphasis on innovation related to ecological and digital transition, with high potential for value creation;
- Ordinance No. 287-A/2025/1, of August 14, which amended Ordinance No. 185/2024/1, of August 14, which approves the model declaration of absence of conflicts of interest for members of management bodies, managers, and employees of public entities covered by the General Regime for the Prevention of Corruption.
Within the scope of case law, we highlight the Judgement of the Constitutional Court No. 785/2025, of August 8, Case No. 881/2025, in which the Constitutional Court ruled unconstitutional a set of rules contained in Decree No. 6/XVII of the Assembly of the Republic, amending Law No. 23/2007 of 4 July, which approved the legal regime governing the entry, stay, departure and removal of foreigners from national territory, in the following terms:
“a) It pronounces the unconstitutionality of the provision of Article 98(1) of Law No. 23/2007 of July 4, as amended by Article 2 of Decree No. 6/XVII of the Assembly of the Republic, for violation of Articles 36(1) and (6), Article 18(2), Article 67(1), Article 68(1), Article 69(1), Article 71(2), and Article 72(1) of the Constitution;
b) It pronounces the unconstitutionality of the provision of Article 98(3) of Law No. 23/2007 of July 4, as amended by Article 2 of Decree No. 6/XVII of the Assembly of the Republic, for violation of Articles 36(1) and (6), Article 67(1), Article 68(1), and Article 69(1) of the Constitution;
c) It pronounces the unconstitutionality of the provision of Article 101(3) of Law No. 23/2007 of July 4, as amended by Article 2 of Decree No. 6/XVII of the Assembly of the Republic, for violating Article 165(1)(b) of the Constitution;
d) It pronounces the unconstitutionality of the provision of Article 105(1) of Law No. 23/2007 of July 4, as amended by Article 2 of Decree No. 6/XVII of the Assembly of the Republic, when read in conjunction with Article 98(3), in the wording resulting from the amendments introduced by Article 2 of Decree No. 6/XVII of the Assembly of the Republic for violation of Articles 36(1) and (6), 67(1), 68(1), and 69(1) of the Constitution.
e) It pronounces the unconstitutionality of the provision of Article 87-B(2), added to Law No. 23/2007 of July 4, by Article 3 of Decree No. 6/XVII of the Assembly of the Republic, for violation of Articles 20(1), 18(2), and 268(4) of the Constitution.
f) It does not pronounce on the unconstitutionality of the other provisions included in the request.”.
Finally, in the Miscellaneous, we highlight the availability of statistical data on Industrial Property Rights (IPR) applications and grants for the month of July 2025, with special mention for the filing of 13,748 applications for registration of national trademarks and other distinctive signs of trade (OSDC) between January and July 2025, representing a 3.5% increase over the 13,280 applications filed in the same period of 2024.

Summary:
1) Article 1(2), Article 2(1)(c), and Article 78 of Council Directive 2006/112/EC of November 28, 2006, on the common system of value-added tax, must be interpreted as meaning that: an activity of managing the refund of value added tax (VAT) that purchasers not resident in the European Union have paid at the time of purchasing goods which they then transport outside the Union constitutes a supply of services separate and independent from the corresponding exempt supply of goods and must, as such, be subject to VAT. Such a supply of services is not covered by the exemption provided for in Article 146(1)(e) of that directive.
2) Article 135(1)(d) of Directive 2006/112 must be interpretedof Directive 2006/112 must be interpreted as meaning that: an activity of managing the refund of value added tax (VAT) that purchasers not resident in the Union paid at the time of purchasing goods that they then transported outside the Union is not covered by the exempt transactions provided for in that article.
3) The principle of protection of legitimate expectations must be interpreted as meaning that: it does not preclude the tax authority from subsequently subjecting certain services to value added tax (VAT), where that administration has, for several years, audited and accepted the taxable person's VAT returns without challenging the classification of those supplies as exempt from VAT and has not informed that taxable person of the change in the national legislation in force which, in its previous version, expressly mentioned those supplies among the activities exempt from VAT. In that context, it is irrelevant that, following a request for an opinion submitted under the national legislation in force, the taxable person received an ex post and non-binding reply from the tax authority according to which those services should be considered ancillary expenses of an exempt supply of goods sharing the same VAT exemption regime applicable to the main transaction.
4) Articles 73 and 78 of Directive 2006/112 must be interpreted as precluding the practice of the tax authority of a Member State which consists in considering that the amounts invoiced in consideration for a value added tax (VAT) refund management service, that is to say, the management fee, correspond to net amounts, which do not include VAT where the supplier has considered its supply to be exempt and it is manifestly impossible for it to pass on retrospectively to the purchasers of goods exempt from VAT the amount of VAT claimed by the tax authority.

The European Innovation Scoreboard 2025, recently published by the European Commission, reveals the progress made by the various Member States in the field of research and innovation. According to the 2025 edition, Portugal continues to grow, in line with the EU trend. With a performance 3% higher than the previous year and ranked 16th among the 27 Member States, it is classified as a Moderate Innovator, with a performance of 90.7% of the European average in 2025.
Innovation in Portugal has continued to perform well since 2018 (+9.0%), despite being slightly below the EU average. The report identifies direct and indirect government support for R&D in companies, the percentage of foreign doctoral students, and public-private co-publications as strengths of innovation in Portugal. The indicator for intellectual property assets shows that trademark applications have remained stable since 2018 and are around the EU average, in line with the profile of countries with a large service sector, such as Portugal. Patent applications under the Patent Cooperation Treaty (PCT) have decreased slightly, by 2% since 2018.
On August 14 provisional statistics were released on industrial property rights (IPR) applications and grants for July 2025, highlighting the following:
(i) Between January and July 2025, 591 applications for national inventions were filed (up from 538 applications filed in the same period last year);
(ii) With regard to concessions, 164 national inventions were granted between January and July 2025, compared to 121 granted between January and July 2024, representing a growth of 35.5%;
(iii) The total number of International Applications and European Patent Applications, via INPI as the Receiving Office, was 42 between January and July 2025 (close to the figure recorded in the same period in 2024). The number of European Patent validations filed in Portugal between January and July 2025 decreased by 25.8% compared to the same period last year, from 1,580 validations filed between January and July 2024 to 1,172 between January and July 2025;
(iv) National trademarks and other distinctive commercial signs (OSDC) accounted for 13,748 registration applications between January and July 2025 (higher than the 13,280 applications submitted in the same period in 2024), representing a growth of 3.5%;
(v) With regard to International Trademark Designations for national examination and registration, there was an increase compared to the same period last year. 601 International Trademark Designations were filed between January and July 2025 and 579 between January and July 2024.
