I. EDITORIAL – AMENDMENT OF THE GENERAL WASTE MANAGEMENT REGIME; DEFINITION OF THE UNIVERSE OF PERSONS LIABLE FOR VALUE ADDED TAX
The month of May was characterized, in legislative terms, by the publication of Decree-Law no. 81/2025, of May 22, which amends the General Waste Management Regime, completing the transposition of Directive (EU) 2018/851, and by the publication of Ordinance no. 242/2025/1, of May 29, which defines the universe of value added tax payers covered by the automatic periodic declaration.
Also noteworthy, at a legislative level, are:
- Decree-Law no. 71/2025, of May 6, which amends Decree-Law no. 176/2003, of August 2, which defines and regulates protection in the event of family burdens under the family protection subsystem;
- Ordinance no. 228/2025/1, of May 21, which approves and regulates the revised Domestic Violence Risk Assessment Tool (RVD-R).
Within the scope of case law, we highlight the Supreme Court of Justice's ruling of May 15, Case no. 741/22.1T8MAI.P1.S1, in which it was ruled: “I. The rules of Portuguese law that cannot be derogated from, particularly for the purposes of applying Article 8(1) of the Rome I Regulation, are those relating to the very existence of a holiday allowance and a Christmas allowance. II. The legal regulation of holiday and Christmas allowances is intended to guarantee workers the availability of money that will allow them to meet the increased expenses that these seasons entail or may entail and, specifically with regard to holidays, to motivate them to enjoy them effectively, and is not based on strictly retributive considerations. III. Even if the individual employment contract is governed by the law of another country (under the terms chosen by the parties), payment of holiday and Christmas bonuses is compulsory for workers whose employment contract is being carried out in Portugal. IV. Referral may be refused by the national courts of a Member State, particularly where the answer to the question raised would have no bearing on the outcome of the dispute or where there is no reasonable doubt as to the interpretation of the provision of EU law at issue”.
Finally, in the Miscellaneous, the Council of Ministers approved the Decree-Law that sets transitional targets for the integration of energy from renewable sources for the industry (16 per cent by 2030) and transport (29 per cent by 2030) sectors, which will be in force until European Union directives on the promotion of energy from renewable sources are transposed.

“I - It is the case law of this Supreme Court that wind farms are buildings, within the meaning and for the purposes of Article 2 of the CIMI, and that their various constituent elements and component parts cannot be registered independently in the land registers, since they do not fulfil the economic element of the concept of a taxable building.
II - However, this Supreme Court has not yet ruled on the question (which is not to be confused with the above) raised in these proceedings, namely whether, in the valuation for the purposes of determining the VPT of the wind farm - which is to be carried out in accordance with Article 46(2), applicable by virtue of Article 38(3) of the CIMI, since it was classified as a “building for industrial purposes” - the wind turbine tower (an element that forms part of the wind turbine) may be registered separately, since it is not a building. 38, both of the CIMI, since it was classified as a “building for industrial purposes” – the wind turbine tower (an element that forms part of the wind turbine) may or may not be included in the valuation, especially when other components of the wind turbine, such as the blades, nacelle and rotor, were excluded from the valuation.
III - In view of the legal relevance of the issue (given the difficulties raised by the valuation of buildings in the ‘industrial’ category, particularly with regard to the elements that constitute them and the distinction between real estate and equipment, as clearly revealed in the proceedings and in the divergence of opinions between the courts and administrative guidelines) and the potential for the controversy to expand (given the proliferation of ‘wind farms’), an exceptional review should be allowed on the question of whether, for the purposes of assessing the wind farm, the AT may disregard the wind turbine towers.”

V.2.1. Economy, Finance and Taxation
The Council of Ministers, meeting on May 19 approved, by written resolution via the government's computer network, a decree-law that will allow greater access, under more favourable conditions, to bank financing for micro, small and medium-sized enterprises and small-to-medium capitalization companies.

The Council of Ministers, meeting on May 29 approved, by written decision via the Government's computer network, a Decree-Law defining transitional targets for the integration of energy from renewable sources into the industry (16% by 2030) and transport (29% by 2030) sectors, to remain in force until the transposition of European Union directives on the promotion of energy from renewable sources.
V.2.2. Industrial Property
On 13 May, provisional statistics were released on industrial property rights (IPR) applications and grants for April 2025, highlighting the following:
(i) In the first four months of 2025, 316 national invention applications were filed (up from 305 applications filed in the same period last year);
(ii) With regard to grants, 100 national inventions were granted between January and April 2025, compared to 67 granted between January and April 2024, representing an increase of 49.3%;
(iii) The total number of International Applications (PCT) and European Patents, via INPI as the Receiving Office, was 27 applications in the first four months of 2025 and 22 applications in the first four months of 2024. The number of European Patent validations filed in Portugal between January and April 2025 decreased by 23.2% compared to the same period last year, from 930 validations filed between January and April 2024 to 714 between January and April 2025;
(iv) National Trademarks and Other Distinctive Signs of Commerce (OSDC) accounted for 8,146 registration applications in the first four months of 2025 (higher than the 7,844 applications filed in the same period of 2024), representing a growth of 3.9%;
(v) Applications for International Trademarks originating in Portugal totaled 64 between January and April 2025, higher than the 51 applications registered in the same period of 2024;
(vi) With regard to International Trademark Designations for national examination and registration, according to data from the World Intellectual Property Organisation (WIPO), there was an increase compared to the same period last year. 352 International Trademark Designations were filed in the first four months of 2025 and 339 in the first four months of 2024.
