I. EDITORIAL - STATE BUDGET FOR 2025; UPDATING OF THE MINIMUM MONTHLY WAGE FOR 2025
The month of December was characterized, in legislative terms, by the publication of Law no. 45-A/2024, of December 31, which approved the State Budget for 2025, as well as the publication of Decree-Law no. 112/2024, of December 19, which updates the value of the guaranteed minimum monthly wage (RMMG) from 1 January 2025.
Also noteworthy, at a legislative level, are:
- Law no. 43/2024 of December 2, which amends Law no. 30/2021 of May 21, approving special public procurement measures;
- Ordinance no. 352/2024/1, of December 23, which regulates the tax incentive scheme for scientific research and innovation, provided for in article 58-A of the Tax Benefits Statute;
- Ordinance no. 358/2024/1, of December 30, which determines the normal age of access to the old-age pension in 2026;
- Law no. 45-B/2024, of December 31, which approves the Major Options Law for 2024-2028 on planning and multiannual budget programming (Major Options Law), which includes the policy measures and investments that contribute to achieving this goal.
Within the scope of case law, we highlight the Judgement of the Constitutional Court no. 895/2024, December 11, Case no. 1330/202326/2022, in which it was decided "a) To rule that article 56 no. 1 of the Portuguese Nationality Regulation (approved by Decree-Law no. 237-A/2006, of 14 December), as amended by Decree-Law no. 26/2022, of March 18, in the part that concerns the starting point for counting the time limit for bringing legal proceedings for the purpose of opposing the acquisition of nationality by effect of will, on the grounds of illegality due to violation of article 10 of Law no. 37/81, of October 3 (Nationality Law), as amended by Organic Law no. 2/2006, of April 17; (…)”.
Finally, in Miscellaneous, it was approved, in the Council of Ministers, the Decree-Law extending the exceptional measures to simplify procedures for producing energy from renewable sources until 31 December 2026.

"I - Good faith, in the context of the abuse of rights (art. 334 of the Civil Code), is also materialised through the principle of precedence of the underlying materiality, which demands the need to evaluate the exercise of the right in material terms, taking into account its effective consequences, with serious and manifest disproportionality of legal positions being of relevance, Good faith therefore prevents manifestly disproportionate exercise, i.e. an imbalance in legal exercise, avoiding disproportionality between the advantages actually gained by the holder of a legal position and the sacrifice imposed on others by the exercise of that same legal position.
II - A foreclosing bank that forecloses on a mortgage in the following situation is acting with an abuse of rights, because it clearly exceeds the limits imposed by the principle of good faith, mediated by the precedence of the underlying materiality: the defendants exchanged with a building company a plot of land for construction by three autonomous fractions, free of liens or encumbrances, and the company having given the mortgage on the plot of land as a guarantee to the foreclosing bank, it was proven that the foreclosing bank at the time of the loan and the risk analysis was aware of the exchange and that the fractions, and that the plots of land, which had been built in the meantime, belonged to the defendants and were exchanged free of any liens or encumbrances, and because the mortgage given to the foreclosure was intended to secure the loan granted to the company that had exchanged, without any consideration or economic benefit for the defendants (third parties to the loan agreement), a solution that formally justified the foreclosure of the three instalments (solely by applying the principle of the indivisibility of the mortgage) without appealing to the underlying materiality, would imply a manifest disproportionality, and the economic imbalance is evident, because the defendants would be left without the plot of land and the exchanged fractions, of which they are the legitimate owners, in other words, they would be left with nothing, while the foreclosing bank has already received payment of part of the debt of the company (borrower), which has since been declared insolvent, in an amount greater than that of the plot of land declared in the deed of exchange."

"I - The loss of the creditor's interest in the agreed service resulting from the default of the other party is legally equivalent to the non-fulfilment of the obligation (article 808, paragraph 1, of the CC) and is objectively assessed (paragraph 2 of the same article), the arbitrary evaluative judgement of the creditor himself being insufficient.
II - The loss of interest may result from the very nature or purpose of the service undertaken, and may also arise from the establishment of an absolute essential term, where the contract stipulates that the term is absolutely fixed.
III - The stipulation that the contract for the reconstruction and extension of the building must be carried out and completed by the contractor, under the agreed terms, within a maximum overall period of 8 (eight) months from the date of commencement of the work (the deadline for which has been set), does not constitute subjection of the obligation to an absolute or fatal essential term.
IV - Once that deadline has passed, it does not immediately lead to the impossibility of the performance, due to the loss of the creditor's interest, nor, consequently, to the conversion of the default into definitive non-fulfilment. It merely creates a situation of default on the part of the debtor/contractor.
V - The mere failure to fulfil an obligation included in a bilateral contract in a timely manner does not, in principle, constitute grounds for the creditor to terminate the underlying contract, but only gives him the right to demand its fulfilment.
VI - If the price of the work has been fixed globally and the owner's authorisation for the changes made on the contractor's initiative has not been given in writing, the contractor is only entitled to the compensation corresponding to the enrichment of the owner (art. 1214, no. 3, of the Civil Code)."

Judgement of the Supreme Administrative Court, of December 4, Case no. 0694/23.9BEPRT: Delay in Justice. Proof. Property Damage. Due Process.

"I - The right to a fair trial is a dimension that must be protected and safeguarded by the Member States, according to a broad conception that is susceptible to diversified materialisation, whose basic and essential meaning consists in the conformation of the process in such a way as to ensure the effective judicial protection of the rights and interests asserted in the process, in accordance with the densification that has been emanating from the various jurisprudence, especially of the ECtHR, in relation to Article 6 of the ECHR.
II - According to the jurisprudence of the national courts and also of the ECtHR, the burden of alleging and demonstrating the facts relating to the damage or harm of a pecuniary nature suffered as a result of the violation of the right to a judgement within a reasonable time falls on the parties, since only a presumption of verification can be drawn in relation to non-pecuniary damage.
III - A strong natural presumption exists and operates in favour of the holder of the right to a judicial decision within a reasonable time, that there has been a significant common psychological and moral damage, of a non-pecuniary nature (damage), which is suffered by all people who go to court and do not see their claims resolved by a final act of the process within a reasonable time (causal link), Therefore, in order to benefit from that presumption, the plaintiff need only allege and demonstrate the existence of the excessive delay, which caused the violation of their right to a judicial decision without undue delay, but without any presumption of damage being formulated in relation to pecuniary damage.
IV - The question of the rules on the burden of proof are rules of law, which, as such, can be known by the Court of its own motion, but such rules of law require the allegation of the essential facts, in relation to which the Plaintiffs bear the burden of allegation.
V - Only those damages that have actually been suffered are counted as pecuniary damage, and it is necessary not only to allege and prove them, but also to establish the causal link between the damage and the harmful fact of the violation of the decision within a reasonable time.
VI - It is not possible to make an overall assessment of the damage to property, as none has been specifically alleged, nor can it be said that the Plaintiffs could not already know all the possible damage to property, as they were not awaiting the outcome of any legal proceedings, and the allegation and quantification of damage to property does not depend on any legal proceedings, as the legal proceedings are already over.
VII - Pursuant to Article 267 of the TFEU, the CJEU has jurisdiction to give preliminary rulings on the interpretation of the Treaties and on the validity and interpretation of acts adopted by the institutions, bodies, offices or agencies of the Union, but only where questions relating to the interpretation and application of rules of law and not to questions of fact are involved."

The Council of Ministers, meeting on 12 December, approved:
- A Resolution of the Council of Ministers approving the National Digital Strategy (NDS) and its governance model;
- A Decree-Law that ensures the implementation of the European regulation on European data governance, designating the competent body to support public sector bodies, the single information point, the competent authorities for data intermediation services and the competent authority for the registration of data altruism organisations;
- A Council of Ministers Resolution approving the development of a Large-Scale Language Model of the Portuguese language of Portugal (Portuguese LLM), as one of the measures that realises Portugal's vision and ambition for Artificial Intelligence (AI), namely to support research, innovation and entrepreneurship in AI and to stimulate the adoption and use of AI in the public and private sectors;
- A Decree-Law abolishing, by merger, the General Secretariat for the Economy, the third entity to be abolished in order to merge it into the bodies restructured in the 1st Phase of the Public Administration Reform, partly for the General Secretariat of the Government and other services and entities;
- A Decree-Law that dissolves, by merger, the General Secretariat for the Environment, the fourth entity to be dissolved in order to merge into the organisations restructured in the 1st Phase of the Public Administration Reform;
- A Decree-Law creating the Climate Agency, I.P., Portugal's first dedicated climate agency;
- A Decree-Law that postpones the entry into force of periodic inspections for motorbikes, tricycles, quadricycles and trailers and semi-trailers, which was initially scheduled for January 1st 2025, to January 1st 2026, unless another alternative legal regime is approved, in which case the new deadline does not apply;

V.2.2. Industrial Property
Provisional statistical data on Industrial Property Rights (IPR) applications and grants, updated to November 2024, was released on 12 December:
i) In the first eleven months of the year, 831 national invention applications were filed, an increase of 5.2 per cent on the 790 applications filed in the same period of the previous year;
ii) As far as grants are concerned, 186 national inventions were granted between January and November 2024, compared to 180 granted between January and November 2023, which represents an increase of 3.3 per cent;
iii) The total number of International (PCT) and European Patent Applications, via the INPI as the Receiving Office, was 63 in the first eleven months of 2024 (lower than the number filed in the first eleven months of 2023);
