I. EDITORIAL – AMENDMENT TO THE NATIONALITY LAW; EXTENSION OF THE EXCEPTIONAL MEASURES TO SIMPLIFY PROCEDURES FOR PRODUCING ENERGY FROM RENEWABLE SOURCES

The month of March was marked, at a legislative level, by the publication of Organic Law no. 1/2024, of 5 March, which made the tenth amendment to Law no. 37/81, of 3 October, approving the Nationality Law, and by the publication of Decree-Law no. 22/2024, of 19 March, which extends the exceptional measures to simplify procedures for producing energy from renewable sources.

Also noteworthy, at a legislative level, are:

Within the scope of case law, the month of March is highlighted by the Judgement of the Constitutional Court no. 198/2024, of 12 March, Case no. 489/2023, in which it was decided: "to not declare unconstitutional the rule contained in article 407, paragraphs 1 and 2, of the Code of Criminal Procedure, interpreted as meaning that an appeal submitted against a decision handed down at the trial stage, but before the trial has begun, which dismisses the nullity of the indictment, should not be submitted immediately, so as its retention does not render it absolutely useless and it does not fall within the possibility set out in that paragraph 2, namely in point a).

Finally, under Miscellaneous, it is worth highlighting the approval, by the Council of Ministers of the National Strategy for the Inclusion of People Experiencing Homelessness 2025-2030.

II- The legal regulation of holiday and Christmas leaves is intended to guarantee workers the availability of money that will allow them to meet the increased expenses that these seasons entail or may entail and, specifically with regard to holidays, to motivate them to enjoy them effectively, and is not based on considerations of a strictly retributive nature.

III- Even if the individual employment contract is governed by the law of another country (under the terms chosen by the parties), payment of holiday and Christmas leaves is mandatory for workers whose employment contract is being carried out in Portugal.

IV- If it is recognised that the plaintiffs are entitled to receive holiday and Christmas leaves, in addition to the remuneration agreed with the defendant, in the period prior to 01.02.2019, if they did not receive such an increase, similarly, in the subsequent period, this would constitute a reduction in their remuneration, in breach of the principle of irreducibility of remuneration.

V- Referral may be refused by the national courts of a Member State, in particular where the answer to the question raised would have no effect on the outcome of the dispute or where there is no reasonable doubt as to the interpretation of the provision of Union law at issue."

"I. An enquiry has been launched on the basis of a report by the Tax Authority, and the Tax Authority has failed to make the notification referred to in article 105 no. 4, (b) of the RGIT. Nothing prevents the Public Prosecution Service from making this notification itself, by the police authorities or by the tax authorities to whom it has delegated the power to carry out enquiries, thus remedying this irregularity, although it is essential that the indictment and judgement state that this notification was made after the 90-day period referred to in point a) of the same rule had elapsed.

II. Tax liability and criminal liability are not to be confused and the latter does not depend on whether or not the tax obligation has been reversed against the defendant in the tax proceedings.

III. When, due to an error of law, the defendant was given a sentence of six months in prison, by reference to article 105 no. 1 of the RGIT, despite the fact that it was always considered that the offence of abuse of trust in question was subsumed to that provided for in paragraph 5 of the same rule, the Court of Appeals cannot modify the sentence imposed, in obedience to the prohibition of reformatio in pejus, but the possible nullity, claimed by the defendant, of the Court's failure to choose the sentence provided for in Article 70 of the Criminal Code, is no longer relevant.

IV. We are unequivocally faced with the vice of insufficiency for the decision of the proven factual material, provided for in Article 410 no. 2 (a) of the Code of Criminal Procedure, when there is an almost complete omission of facts relating to the current economic and financial situation of the defendants, without any justification for such absence of facts and without any impossibility of obtaining elements capable of supporting the definition of the omitted current situation.

V. The application of the condition referred to in article 14 no. 1 of the RGIT requires consideration of the defendant's real economic situation and his ability to pay the amount owed, and this rule must be interpreted in conjunction with article 51 no. 2 of the Criminal Code, making its application subject to criteria of weighting, the principles of reasonableness and the dignity of the person, as well as respect for the fundamental rights of the convict himself, such as the guarantee of the minimum necessary for his subsistence."

"I. Recordings and photographs obtained by private individuals generally constitute documentary proof. Their admissibility and use as proof are regulated in article 167, § 1 CPP.

II. It is necessary to ascertain the lawfulness or unlawfulness of the conduct that led to it, since this is assumed by the legislator to be an essential condition for concluding on the procedural judgement.

III. Attention should be paid to the criminal rules that refer to them, particularly those whose purpose is to protect fundamental rights related to the human personality, such as privacy, image or verbal communication.

IV. The verification of just cause, in order to exclude the criminal liability of the private individual and admit the evidential use of the material, is focused precisely on the moment when it was obtained - which does not coincide with its use in criminal proceedings.

V. Case law has admitted their use as proof, if: a) the content of the recordings or photographs does not respect the core of the private lives of those targeted; and b) there is just cause for obtaining them.

VI. This "core" of privacy should cover both intimacy and privacy, although with regard to the latter, it is understood that there is a certain elasticity as to its exact scope of protection.

VII. With regard to the compatibility of interests that will have to occur at the level of proof, recourse has been made to the possibility of restricting rights, provided for in § 2 of Article 18 of the Constitution, resolving in favour of the prevalence of the right to security or the interests inherent in the collective demand for effective justice, based on criteria of proportionality, adequacy and necessity. These guide the judge in weighing up on a case-by-case basis, taking into account the circumstances of the specific case, between the right to privacy on the one hand and the importance of the proof given the seriousness of the crime in question, in order to conclude on its admissibility or inadmissibility.

VIII. The just cause for obtaining the images will therefore have to be reached through a judgement weighing up the conflicting interests.

In this judgement, the causes of exclusion of illegality prevail, which could justify the removal of the prohibition of the conduct of the private individual who obtained these means of proof without consent."

V.2.1. Economy, Finance and Taxation

On 14 March, the Council of Ministers approved several pieces of legislation, including the following:

  • The decree-law amending the Statute for Professionals in the Field of Culture;
  • The decree-law regulating arbitration for the assessment of the grounds for termination of a collective agreement and arbitration for the suspension of the period of survival, implementing commitments made in the Decent Work Agenda;
  • The resolution approving the draft of investment tax contracts and the addenda to the investment tax contracts previously signed and declaring the cancellation of the investment tax contracts which, in the meantime, no longer fulfil the conditions for their continuation;
  • The decree-law transposing into national law the Directive (EU) 2022/2380 on the harmonisation of the laws of the Member States relating to the making available on the market of radio equipment;
  • The decree-law that ensures the implementation in the Portuguese legal order of Regulation (EU) 2017/745 on medical devices;

On 21 March, the Council of Ministers approved the decree-law that abolishes the Regional Health Administrations, I.P. (ARS, I.P), with the remaining attributions being succeeded by other services and entities.

The following diplomas were also approved:

  • The decree-law that introduces legislative changes that frame the operation of the new "Company 2.0" information system, with a view to improving the services provided within the framework of the online company incorporation scheme by providing new technological solutions and digital services that are more suited to current times;
  • The resolution determining the exceptional VAT eligibility regime and the simplification of procedures associated with the Development and Maintenance of a rescEU Stockpile project;
  • The decree-law that makes corrections and clarifications to the Legal Framework for Urbanisation and Building;

On 25 March, the Council of Ministers approved the National Strategy for the Inclusion of People Experiencing Homelessness 2025-2030. The new strategy introduces a number of measures, focusing on prevention and the creation of an integrated risk warning system; personalised intervention with case managers at local level; an increase in housing first solutions and shared flats; specialised intervention with particularly vulnerable groups and strengthening the monitoring of local support networks for people at risk of or experiencing homelessness.

V.2.2. Industrial Property

On March 13, provisional statistics were released on Industrial Property Rights (IPR) applications and grants for February 2024, including the following:

i) In the first two months of the year, 121 national invention applications were filed and 35 national inventions were granted, compared to 40 granted in 2023;

ii) The number of European Patent validations filed in Portugal between January and February 2024 grew by 3.2 per cent year-on-year (518 in 2024, 502 in 2023);

iii) There were 3,983 applications for registration of National Trademarks and Other Distinctive Trade Signs (OSDC) between January and February 2024, representing a decrease of 1.7%. In the same period, 1,588 National Trademarks and OSDCs were granted (3.916 in 2022);

iv) The number of objects included in National Design applications went from 148 between January and February 2023 to 56 in 2024.

On 18 March, the European Patent Office (EPO) announced that it will be making a new package of incentives available to micro-enterprises, universities, non-profit organisations, public research institutions and individuals for filing European patent applications, through a reduction in fees, regardless of their nationality or domicile.

The fee reduction will apply to fee payments made from 1 April onwards for European patent applications and Euro-PCT applications that have entered the European phase, regardless of their filing date.

On 20 March, the European Commission (EC) published a recommendation to combat counterfeiting and better protect intellectual property (IP) rights. The main actions proposed by the EC include:

  • Designate a single point of contact for enforcement issues and extend the use of existing tools, such as the IP Enforcement Portal provided by EUIPO;
  • Encourage signatories of the Memorandum of Understanding on the sale of counterfeit goods on the Internet to seek "trusted signaller status" under the Digital Services Regulation;
  • Adapt new procedures to combat new counterfeiting practices;
  • Promote the use of alternative dispute resolution for all IP disputes, offering a cost-effective and efficient option, especially for cross-border disputes and SMEs.
  • Re-evaluate and potentially increase the maximum sanctions applicable to serious criminal offences in the field of IP;
  • Strengthening the role of the supervisory authorities to continue detecting and combating counterfeiting;
  • Developing practices aimed at faster, more economical and environmentally friendly storage and destruction of counterfeit goods;
  • Adapting IP practices to Artificial Intelligence and virtual worlds, using Blockchain technology for supply chain tracking as well as content recognition systems to detect counterfeit goods and pirated merchandise;
  • Integrating IP content into national training and education programmes, especially in areas such as enforcement and business administration.
