I. EDITORIAL – SURROGACY AGREEMENT
In this month of August, we highlight the approval of the surrogacy agreement to the cases of a woman with absence, injury or severe disease in the of uterus that prevents absolutely and definitively a pregnancy.
The Act No. 25/2016 of August 22, allows the surrogacy agreement if exceptionally and free of any charge between the parties.
We also highlight the Decree-Law No. 47/2016 of August 22, which amends the partial tax exemption regime regarding the incomes from patents and other intellectual property rights and the Act No. 27/2016 of August 23, which approves measures to create a network of centers for collection of animals in order to modernize the municipal veterinary services, and prohibits the slaughter of stray animals as a method of population control.
In this month, regarding relevant case law from Portuguese Courts, notice the Judgment of the European Court of 28 July 2016, Case C-57/15 and Judgment of Coimbra’s Court of Appeal, of 06 July 2016, regarding Case No. 132/11.0TBLDS.C1.
The first judgment concerns the interpretation of Article 14 of Directive 2004/48/EC of the European Parliament and of the Council of 29 April 2004 regarding the respect of intellectual property rights.
Finally, it is also worth noting the approval, by the Council of Ministers, of Decree Law amending the criteria for sustainability of production and use of biofuels and bioliquids and biofuels promotion mechanisms on land transport, and sets mandatory incorporation limits of biofuels for the years 2011 to 2020.
